TERMS AND CONDITIONS

A. RESPONSIBILITIES AND SAFETY

Outdoor activities in Greenland take place in remote and potentially hazardous environments. By participating, you acknowledge and accept that risks remain even when the guide follows best practice and safety procedures. Such risks include, but are not limited to: rough terrain, cold, rapidly changing weather, remoteness, wildlife encounters, transport delays, equipment failure and limited access to medical assistance. We recommend all participants ensure sufficient insurance.

As our customer you are responsible for:

• Personal insurance: The participant is responsible for all costs relating to search and rescue, emergency evacuation and medical treatment. We strongly recommend travel insurance and rescue insurance covering helicopter evacuation in Greenland. Insufficient insurance can result in payment for Search and Rescue operations and other safety measures.

• Participants are responsible for obtaining correct information about insurance requirements.

• Accepting guide authority in safety: The guide has the authority to request evacuation when they assess a serious or potentially life-threatening condition to exist. The guide has full authority to change the route, pace, grouping, itinerary or to deny or terminate participation for safety reasons, including but not limited to weather, health, fitness, behavior, intoxication or failure to follow instructions. No refund is given in such circumstances.

• Participants must follow guide in all safety matters and guide instructions at all times, including keeping the group together when the guide instructs them to do so.

• Liability for personal belongings, personal gear as well as anything rented from or provided for by Assut Adventures I/S.  

• Fitness level: All participants must be in good physical condition and at a minimum be able to complete activities listed in the guidelines for participation in the Safety Manual.

• Communicate physical health and medical conditions prior to the start of the activity. Any relevant health information must be provided to Assut Adventures I/S and the guides.

• Communication of physical and mental stress level during the activities.

• Bringing suitable clothing and equipment with sufficient warmth, breathability and durability.

• Compliance with Greenlandic legislation.

• For group tours, participants must respect the safety and wellbeing of the whole group, which may include waiting time or pace adjustments.

Assut Adventures I/S is responsible for:

• Providing information on how to reduce risks when moving in the Greenlandic landscape.

• Assessing weather conditions prior to activities.

• Organizing route and safety communication prior to activities outside of the town limits; route, expected return time, group size and relevant information.

• Providing safety instructions in critical situations.

• Providing relevant safety communication equipment for the activities.

• Changing the route, itinerary and possibly canceling the tour based on the safety of the customers and staff/guides.

Assut Adventures I/S is not responsible for:

• Weather conditions. We reserve the right to cancel or change the itinerary of any tour based on weather conditions and safety of the participants and staff.

• Losses, additional expenses or any costs due to delay in transfer, changes of transportation, cancellations or delays as a result of accidents, sicknesses, strikes, damage, technical issues on flights, third party negligence, weather, equipment failure or malfunction, blockades of airports, war, crimes, changes in schedule etc.

• Customer’s arrival at the agreed designated time and place of departure of the activity, unless this is directly related to misinformation by Assut Adventures I/S.

GENERAL WAIVER OF LIABILITY

Assut Adventures I/S does not assume responsibility for accidents, injuries or death that can be traced to the participants’ negligence, acts of third parties or external circumstances such as weather, other natural occurrences, epidemics, known or unknown health conditions of the participants, force majeure or other external causes.

Assut Adventures’ activities are open to people of all ages and genders, but all participants must be able to comply with the physical qualifications for all events. Participants under the age of 18 must present written consent from a parent or legal guardian.

B. TERMS AND CONDITIONS - BOOKING AND CANCELLATION

GENERAL TERMS

All rates listed are in Danish Kroner (DKK). There is no VAT in Greenland.

Prices are always per person unless specifically stated so (e.g. for larger groups).

Payment must be made in advance. Payment is made at booking unless agreed written agreement is made on other conditions.

Tours may require a minimum number of participants to run (e.g., 2 people or 10 people). While we strive to fill our tours, we cannot guarantee this.

Assut Adventures I/S reserves the right to change prices without prior notice. For bookings that have already been confirmed and paid, price changes will only be made if the listed price was the result of a direct error or changes in third-party prices.

The following are not included in the tours or activities unless specifically mentioned as included at the time of purchase.

• Insurance

• Flights to/from Greenland

• Meals

• Personal gear

• Rescue costs

• Accommodation

CANCELLATION

Cancellation must be done via e-mail to info@assut.gl.

Cancellation fees are as follows:

Full refund for cancellation:

• Day tours without transport (boat or helicopter) 48 hours’ notice.

• Multiday tours with flight (helicopter or plane): 33 days’ notice.

Limited refunds are given in the following cases:

• Tailor-made tours and Running camps: 100% excluding any prices to third parties (transportation, accommodation etc.): 33 days’ notice.

• Other Multiday tours: 100% excluding any prices to third parties (transportation, accommodation etc.): 15 days’ notice.

Note on third party costs: Any tour including helicopter service: 100 % refund at 33 days’ notice of transportation costs. Cancellation terms for boat charter in Greenland are typically 7 days, but Assut Adventures I/S cannot guarantee this due to the many different boat operators.

Cancellation received less than 48 hours prior to departure will be charged full price.

If Assut Adventures I/S cancels a tour for safety or operational reasons, customers will be offered either a full refund or the option to rebook. We are not liable for any additional costs such as flights, inconveniences, accommodation or other travel expenses.

C. THIRD PARTY SERVICE, TRANSPORT AND ACCOMMODATION PROVIDERS

Assut Adventures I/S works with other tourism providers, tour operators, transportation companies, hotels, agents, municipalities, government agencies etc. Assut Adventures I/S is not responsible for any negligence or service failure by third-party providers.

Assut Adventures I/S reserves the right to forward any reasonable claims from our customers to the relevant companies.

All offers made by us are open for acceptance within fifteen calendar days from the date of issue, unless otherwise specifically stated therein, and are subject to the services of the goods offered.

INVOICING AND PAYMENT

All purchase orders issued by you shall specify as a minimum the type and quantity of goods or services requested, applicable unit prices, delivery place and requested delivery dates. No purchase order shall be binding on us unless and until confirmed by us in writing.

We accept invoices for goods and services with a standard payment term of at least 14 days.

Assut Adventures I/S does not pay the service fee for international payments to our bank account. Payments to the bank account must be made with clear information about the goods or services and the identification of the individual.

The general payment deadline for invoicing from Assut Adventures I/S is 14 days. If payment is made later than the deadline, 3% of the value will be added per month. However, a minimum of DKK 150.

Payments cannot be made in instalments or with deductions unless and until confirmed by us in writing.

AGENTS

Agents or other service providers can in some cases be given a discount or refund code.

Refund or discount codes provided by Assut Adventures I/S will only give the right to reduced costs or agent fees for the services provided by Assut Adventures, unless our partners in transportation, accommodation etc. have agreed to the same business model.

Agents have the same rights and obligations for cancellations as private customers.

D. PRICES

Assut Adventures I/S is not responsible for any changes to external costs such as insurance costs, cost of transportation to and from Greenland, cost of accommodation, additional transportation fees, local or national taxes, etc.

After payment by the customer, the price is guaranteed against any surcharge, unless an increase is due to government laws or currency changes. Assut Adventures I/S will absorb an amount equivalent to 5 % of the package price. Amounts that exceed 5 % will be charged and customers will be entitled to cancel their booking with a full refund if the surcharge exceeds 15%.

E. GENERAL BUSINESS CONDITIONS

INTELLECTUAL PROPERTY RIGHTS TO ASSUT ADVENTURES I/S

Assut Adventures I/S owns full rights to the use of our name and logo.

As long as Assut Adventures I/S hosts Nuuk Five Peaks, we reserve the full rights to the name and the brand of the event, and the route. 

SERVICES AND KNOWLEDGE

The following applies in cases where Assut Adventures I/S offer expertise and knowledge services in the form of either reports, strategies, coaching sessions or other services.

In such cases Assut Adventures I/S must always be cited correctly and with name.

THE USE OF PHOTOS

Assut Adventures I/S may take photos during activities for documentation and promotional use. We will always respect privacy and will not publish identifiable photos of guests without consent.
We reserve the right to use general, non-identifiable images taken during tours (for example group photos at a distance or landscape photos including participants).

DATA PROTECTION

We comply with applicable data protection laws in Greenland. We only collect and store personal data necessary to deliver our services. Data is stored securely and only shared when required to deliver services or by law.

F. RESOLVING DISPUTES

Activities of Assut Adventures I/S are subject to and only to the legal system in Greenland.

Customers cannot change the terms or conditions by stating so. No such conflicting, contrary or additional terms and conditions shall be deemed accepted by us unless and until we expressly confirm our acceptance in writing.

Any complaint made with the intention of compensation or reduction in cost must be sent to info@assut.gl no later than 10 days after the end of the activity. Any claim for compensation received later than 10 days after the end of the activity is automatically rejected.

Any complaint must first be raised with Assut Adventures I/S so that we have the opportunity to resolve the matter through dialogue and negotiation.

If no agreement is reached, the dispute shall be finally settled by the ordinary courts of Greenland in accordance with Greenlandic law. The legal venue shall be the court with jurisdiction at the registered address of Assut Adventures I/S.

Any complaint made with the intention of improving our services is always welcome.

G. AMENDMENTS

The terms and conditions apply to the information listed at assut.gl at the time of the purchase.

Assut Adventures I/S reserves the right to change the terms and conditions without notice by publishing new information on the website.
